Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ICU Desk (the “Service”), provided at app.icudesk.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Medical disclaimer — decision support only. ICU Desk provides calculators and checklists intended to support, not replace, the judgement of a qualified clinician. Outputs (including creatinine-clearance values, dosing references, risk scores, and extubation criteria) are for informational purposes only, may contain errors, and must be independently verified against primary references, the patient’s full clinical picture, and your institution’s protocols before any clinical decision is made. ICU Desk is not a diagnostic device and does not provide medical advice. You are solely responsible for all clinical decisions.

1. Eligibility

The Service is intended only for registered clinicians and other authorised healthcare professionals acting within their scope of practice. By using the Service, you represent that you meet these criteria and that your use complies with all laws and professional obligations that apply to you.

2. Accounts and security

You are responsible for maintaining the confidentiality of your account and for all activity under it. Do not share your account or sign-in credentials. Notify us promptly at [email protected] if you suspect unauthorised use.

4. Your data and responsibilities

You are responsible for the accuracy and lawfulness of the data you enter and for ensuring you have an appropriate basis to process it. As described in our Privacy Policy, for the clinical data you enter, you and/or your institution act as the data fiduciary and ICU Desk acts as a processor on your behalf. You retain responsibility for compliance with your institution’s policies and applicable data-protection law. Where you record an optional patient name, or enable the ICU Family Companion (which shares a curated update and diary with relatives via a per-patient code), you confirm you have obtained the consent required under applicable law.

5. Intellectual property

The Service, including its software, design, and content (excluding the data you enter), is owned by ICU Desk and protected by copyright and other applicable laws. © 2026 ICU Desk. All rights reserved. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You retain ownership of the data you enter.

6. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that clinical outputs are accurate or complete.

7. Limitation of liability

To the maximum extent permitted by law, ICU Desk and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from clinical decisions made in reliance on the Service, loss of data, or loss of profits, even if advised of the possibility of such damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

8. Indemnity

You agree to indemnify and hold harmless ICU Desk and its operators from any claims, damages, or expenses arising out of your use of the Service, your clinical decisions, or your breach of these Terms or of applicable law.

9. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or its users. You may request deletion of your account by contacting [email protected].

10. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. We will update the “Effective date” above and, where appropriate, notify you within the app. Continued use after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of India, and the courts at the operator’s principal place of business shall have exclusive jurisdiction, without regard to conflict-of-laws rules.
